A Utah judge is deliberating on the tension between the public interest to know case details and the defense attorneys' concerns that a media swarm could compromise the defendant's constitutional right to a fair hearing.

The defendant's lawyers have joined with the local sheriff’s office in petitioning Judge Tony Graf to forbid filming in the proceedings.

Prosecution and Possible Capital Punishment.

Prosecutors have charged Tyler Robinson with aggravated murder in connection with the 10 September fatal shooting of the activist on the UVU campus in Orem. The state has announced plans to ask for execution.

During the hearing, Robinson was brought in with shackles on his hands and feet while dressed in a business attire. He exchanged a smile with family members seated in the courtroom gallery, where his mother was seen wiping tears.

This was his first physical court appearance; previous appearances had been conducted via remote connection from jail.

News Organizations Fights for Access.

A coalition of major and regional news organizations, including the Associated Press, is lobbying to maintain press freedoms in the case.

Judge Graf has previously noted the case's intense public attention and has issued rulings to protect the defendant’s presumption of innocence.

This includes a private session in late October where lawyers debated courtroom attire and security protocols. Under the subsequent order, Robinson may wear civilian attire during pretrial hearings but must remain shackled due to security concerns. The judge also banned media from filming or photographing the shackles.

An open court “protects the fairness of the legal process” and fosters trust in the court system.

Lawyer Michael Judd, representing the media coalition, argued the judge to let the press to comment on any future requests for closed hearings. He pointed out that trials in the U.S. have a history of being public proceedings, proving fair trials can be carried out while ensuring transparency.

Current media protocols in Utah often designate visual documentation to one photographer and one videographer, whose images are then shared with other outlets. Other journalists and members of the public are typically permitted to attend to listen and take notes.

Victim's Family and Political Statements.

Charlie Kirk’s widow, Erika Kirk, has publicly called for open access, stating, “We deserve to have recording in there.” Her husband was a political ally of Donald Trump who worked to mobilizing young voters for conservatism.

The legal team has argued that case coverage has reached the highest levels, citing remarks from Donald Trump soon after the arrest where he stated, “With a high degree of certainty, we have him,” and said, “It is hoped he gets the death penalty.”

Issue of Misinformation.

Lawyer Kathy Nester has highlighted an issue about digitally altered versions of Robinson’s first mugshot circulating online, creating misinformation about the case. Some altered photos purport to show Robinson crying or having an outburst in court, events which did not occur.
