The ex-lawyer for the former president has resigned as the chief federal prosecutor in the state. This decision was prompted by a judicial decision that challenged her right to hold the office.

Attorney General's Statement

The head of the Justice Department, the Attorney General, announced Habba's resignation on the start of the week. She commented that the appeals court finding made it "untenable" for Habba to lead the department effectively.

"Do not interpret following the order as giving up," she wrote. "My fight will now reach across America."

Legal Background

Habba's exit follows closely on a federal appellate panel found that she had been unlawfully serving as US attorney. This judgment is could influence many prosecutions in the state.

The judicial panel said that a interim role that skirted confirmation by the US Senate violated the statute on vacant positions.

It was also stated that she will stay on at the Department of Justice as a top consultant. Habba plans to seek further review of the disqualification, with hopes of a reversal.

On a social media platform, she wrote that the court "must not override the appointment of attorneys entrusted with executing the primary duty of the administration of enforcing the law."

Connection to Donald Trump

The 41-year-old attorney, originally became part of Trump's personal legal team in recent years. She later represented her client in his New York criminal case in 2024, when he was guilty verdict on dozens of charges of document fraud.

Before her appointment to the federal prosecutor position, Trump had stated he was naming her as his presidential counsellor during his second administration, calling her as "unwavering in her loyalty" and a "tireless advocate for justice".
